Currently, employer-sponsored group health plans that have less than 100 participants that are fully-insured, self-insured or a combination of both, are not required to file a Form 5500. In July 2016, the DOL and Internal Revenue Service (IRS) proposed to implement significant changes which would increase the annual reporting obligations for nearly all health and welfare plans. The proposed changes would eliminate the small plan exception and would require all employer-sponsored group health plans subject to ERISA to file a Form 5500, regardless of the plan’s size.

In July of 2015, the Department of Labor announced a proposed rule that would extend overtime rules to millions of workers. The new rule which is effective December 1, revises the salary component of “white collar” exemptions (executive, administrative and professional exemptions) as well as highly compensated employee exemptions.
PCORI, the “Patient-Centered Outcomes Research Institute”, is a non-profit entity that compares the effectiveness of medical treatments. The Affordable Care Act imposed a tax to fund the institute which applies to health flexible spending arrangements and HRA plans. The very first PCORI reporting requirement was back in July of 2013.
